PLEASE READ THESE TERMS OF USE CAREFULLY. THIS AGREEMENT CONTAINS IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS AND OBLIGATIONS.

1. Parties and Acceptance of the Agreement

This Terms of Use ("Agreement") constitutes a legally binding agreement made between the owner and developer of the "Headphone Cleaner" application ("Developer," "we," "us," or "our") and you, the user who downloads, installs, or uses the application ("User," "you").

By downloading, installing, or using the Application, you acknowledge that you have read, understood, and agree to be bound by all terms and conditions of this Agreement and our Privacy Policy, which is an integral part of it. If you do not agree with these terms, you must not use the Application.

2. Description of Service

Headphone Cleaner is a utility tool designed to help clean water and debris from audio output devices such as headphones, earphones, and phone speakers by generating specific sound frequencies and device-specific haptic vibrations.

3. MANDATORY SAFETY WARNINGS AND USER RESPONSIBILITIES

THIS SECTION IS CRITICAL FOR YOUR SAFETY AND THE SAFETY OF YOUR DEVICES. FAILURE TO COMPLY WITH THESE WARNINGS MAY RESULT IN SERIOUS PERSONAL INJURY OR PERMANENT DEVICE DAMAGE.

PROHIBITION OF USE WITH HEADPHONES ON:

The cleaning process generates high-intensity sound frequencies that can be dangerous to human hearing. The Application ABSOLUTELY MUST NOT BE USED WHILE HEADPHONES OR EARPHONES ARE WORN IN OR ON YOUR EARS. Before starting the process, ensure you have removed your headphones and placed them at a safe distance. The User is solely responsible for any hearing damage or personal injury resulting from failure to comply with this warning.

RISK OF DEVICE DAMAGE:

The sounds and vibrations produced by the Application may cause damage to sensitive electronic components (e.g., speaker diaphragms, haptic engines) with excessive or improper use. It is your responsibility to maintain a reasonable volume level and not to use the Application for any purpose other than its intended use. The Developer cannot be held liable for potential device damage resulting from the use of the Application.

VOLUME CONTROL:

When using the Application on your phone's speaker, it is the User's responsibility to set the volume to a reasonable level that will not damage the device or disturb others in your vicinity.

4. Intellectual Property Rights

The Application itself, including but not limited to its interface design, source code, graphics, text, logos, and its proprietary sound and haptic cleaning algorithms, and all of its content and functionality, are the property of the Developer. These elements are protected by copyright, trademark, and other intellectual property laws.

5. License

Subject to your compliance with this Agreement, the Developer grants you a limited, non-exclusive, non-transferable, and revocable license to use the Application for your personal, non-commercial purposes.

6. Subscriptions and Payments

Access to additional features of the Application ("Premium" or "Pro") may require an in-app purchase or a subscription. All payments and subscription management are handled through the Apple App Store and are subject to the App Store's own terms and conditions.

7. Prohibited Activities

In using the Application, you agree not to:

Use it for any illegal purpose or in any way that violates applicable laws or this Agreement.
Intentionally disregard the safety warnings outlined in Section 3.
Attempt to reverse engineer, decompile, or disassemble any part of the Application.
Offer a commercial service by copying, imitating, or modifying the Application.

8. DISCLAIMER OF WARRANTIES

THE APPLICATION IS PROVIDED TO YOU "AS IS" AND "AS AVAILABLE." THE DEVELOPER MAKES NO PROMISES OR WARRANTIES, EITHER EXPRESS OR IMPLIED, THAT THE APPLICATION WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT IT WILL COMPLETELY OR PARTIALLY REMOVE WATER, DIRT, OR DUST FROM YOUR DEVICE. THE ENTIRE RISK AND RESPONSIBILITY FOR THE USE OF THE APPLICATION LIE SOLELY WITH YOU.

9. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM:

Your use of or inability to use the Application.
Any hearing damage, personal injury, or third-party harm resulting from your failure to adhere to the safety warnings in Section 3 of this Agreement.
Any hardware failure or damage to your headphones, phone, or other devices as a result of using the Application.
Any loss of data or loss of profit.

10. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the Republic of Turkey. Any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the Courts and Execution Offices of Ä°stanbul.

11. General Provisions

Entire Agreement: This Agreement constitutes the entire agreement between the parties and supersedes all prior oral or written agreements.
Severability: If any provision of this Agreement is found by a court of competent jurisdiction to be invalid or unenforceable, that provision shall not affect the validity of the remaining provisions of the Agreement.
No Waiver: The failure of the Developer to enforce any right or provision in this Agreement shall not constitute a waiver of such right or provision.

12. Changes to This Agreement

We reserve the right to unilaterally update this Agreement from time to time. Changes will become effective the moment they are posted within the Application or on our website with an updated "Last Updated" date. Your continued use of the Application after such changes constitutes your acceptance of the new Agreement.
