Pactly Terms of Use

These Terms of Use (“Terms”) govern your use of the Pactly app (the “App”), operated by Ghaith Labs (“we,” “us,” or “our”).

By creating an account or using Pactly, you agree to these Terms. Our Privacy Policy explains how we process information and the choices available to you. Accepting these Terms does not grant device permissions or replace a separate in-app agreement. If you do not agree to these Terms, do not use the App.

1. Eligibility

You must be at least 13 years old to use Pactly.

If you are below the age of majority in your country, you may use the App only with the permission of a parent or legal guardian.

2. Your Account

You are responsible for keeping your sign-in details secure and for activity under your account. You can delete your account at any time from Profile in the App.

3. Pacts and Your Content

You keep ownership of the pact names, goals, notes, messages, and photos you submit. You must have the right to share them. You give us a limited license to host, process, resize or re-encode photos, and display your content as needed to operate Pactly, including safety checks and translation for those checks. Shared pact content is displayed to pact members; private encouragements are displayed to their sender and recipient. This license does not permit us to sell your content or use it for advertising.

Shared text, private encouragements, and photos undergo automated Google Cloud safety checks, including translation when needed. You must accept the content-safety explanation before actions that require these checks. If you decline, you can still read existing pacts and check in without a note. Checks may reject content or prevent publication if unavailable. Authorized safety reviewers may inspect reported content, including private messages. The Privacy Policy explains the processing and your choices. Only invite people you trust, and avoid sharing sensitive personal information.

Inactivity-sharing is enabled by default when joining a pact. You can change the selected recipients in pact settings, but an empty list uses the organizer as the fallback recipient. The organizer may also receive a longer-inactivity group-health reminder even when other recipients are selected. The current App does not offer an option to prevent all such organizer reminders while remaining in the pact. These reminders can identify the inactive member and describe their inactivity. Receiving a reminder also depends on the recipient's notification preferences and quiet hours.

Device notifications and pact photos are optional. Notification permission does not control who receives reminders about your inactivity or turn off analytics. Product analytics is enabled automatically in the production App with no separate opt-in prompt or in-app off switch; the Privacy Policy explains what it collects. Notifications are for encouragement and must not be relied on for emergencies or safety monitoring.

Pactly is a tool for encouragement. It is not medical, financial, or professional advice, and you are responsible for the goals you choose.

4. Acceptable Use

You agree not to:

  • Harass, shame, threaten, or bully other members;
  • Post content that is unlawful, hateful, sexually explicit, or infringes the rights of others;
  • Impersonate another person or misuse invite links;
  • Send spam, or attempt to access accounts or pacts that are not yours;
  • Reverse engineer, disrupt, or overload the App or its servers, except where the law allows.

We may remove content or suspend accounts that break these Terms. You can report abuse at dydemiryasir@gmail.com.

5. Subscriptions

Optional Pactly Pro subscriptions are purchased through the App Store. The purchase screen shows the price, billing period and renewal terms before purchase. Manage or cancel automatic renewal through your Apple account settings. Deleting your Pactly account does not cancel a subscription, and account deletion is available without first cancelling. Refunds are handled under the applicable store rules and mandatory consumer rights.

6. Intellectual Property

The App, including its name, logo, design, animations, and code, is owned by Ghaith Labs or its licensors and is protected by intellectual property laws.

7. Changes and Availability

We may update, change, or discontinue any part of the App at any time. The App requires an internet connection, and some features may require an updated version.

8. Disclaimer

The App is provided “as is” and “as available,” without warranties of any kind, to the fullest extent permitted by law. We do not guarantee that the App, notifications, or reminders will be uninterrupted, timely, or error-free.

9. Limitation of Liability

To the fullest extent permitted by law, Ghaith Labs is not liable for any indirect, incidental, special, or consequential damages, or for any loss of data, arising from your use of the App. Nothing in these Terms limits rights you have under mandatory consumer protection laws.

10. App Store Terms

If you downloaded the App from the Apple App Store, you also agree to Apple's Standard End User License Agreement. Apple is not responsible for the App or its content. If you downloaded it from Google Play, Google Play's terms also apply.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after an update means you accept the revised Terms.
